Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the website at vizwp.com, your Viz account, and the Viz WordPress plugin and related cloud features (together, the “Service”). Please read them carefully. By using the Service, you agree to these Terms.
1. Agreement to these terms
By accessing or using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you are using the Service on behalf of an organization, you represent that you are authorized to accept these Terms for that organization. If you do not agree, do not use the Service.
2. The service
Viz identifies and classifies traffic to your WordPress site, including humans, search engines, and AI bots. The plugin runs on your own WordPress installation. Optional cloud features let you sync classified events to us for cloud dashboards, and paid plans add AI visibility monitoring - we query AI answer engines about your brand on a schedule and report how they describe and cite you. We may add, change, or remove features over time.
3. Accounts and eligibility
You must provide accurate information when creating an account and keep it up to date. You are responsible for safeguarding your credentials and for all activity under your account. Notify us promptly of any unauthorized use. You must be at least 16 years old, or the age of digital consent in your jurisdiction, to use the Service.
4. Plans, billing, and renewals
- Free tier. We offer a free plan for a single site. We may set reasonable limits on free usage.
- Paid plans. Fees, features, and limits are described on our pricing page. Unless stated otherwise, subscriptions renew automatically for the same term until canceled.
- Billing via Paddle. Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle handles all customer service inquiries relating to payments and returns. By purchasing, you also agree to Paddle's Buyer Terms. Paid plans are billed per tracked website, monthly or annually, in USD; Paddle calculates and adds any applicable taxes at checkout. If a payment fails, we may suspend paid features.
- Changes and cancellation. You can cancel at any time, effective at the end of the current billing period. Refunds are governed by our Refund Policy.
5. Plugin license and cloud rights
The Viz WordPress plugin code is free software, licensed under the GNU General Public License, version 2 or later (GPLv2+), consistent with the WordPress ecosystem. Your rights in the plugin code are governed by that license.
The hosted cloud service, the Viz name and logos, the bot-signature database, and our websites are proprietary and are not covered by the GPL. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable right to use the cloud Service for your own sites during your subscription.
6. Acceptable use
You agree not to:
- Use the Service in violation of any law or third-party rights.
- Interfere with or disrupt the integrity or performance of the Service, or attempt to gain unauthorized access to it.
- Reverse engineer, resell, or sublicense the cloud Service except as expressly permitted.
- Upload malicious code or use the Service to store or transmit unlawful, infringing, or harmful content.
- Circumvent usage limits, authentication, or security features.
7. Your data and responsibilities
The plugin logs request data about visitors to your site, stored first in your own database. As the operator of your site, you are responsible for your visitors’ data: for having a lawful basis to process it, providing any required privacy notices, obtaining any required consent, and configuring the plugin’s privacy controls (such as human logging, admin exclusion, and retention) appropriately for your obligations.
If you enable cloud sync, you instruct us to process the synced data on your behalf to provide the Service, and you confirm you have the rights and permissions necessary to do so.
8. Intellectual property
Except for rights expressly granted to you, we and our licensors retain all right, title, and interest in the cloud Service and our brand. You retain all rights to the data generated on and stored in your own site. Feedback you choose to provide may be used by us without restriction.
9. Third-party services
The Service may integrate with third-party services, such as Paddle.com (our payment processor and Merchant of Record) and infrastructure providers. Those services are governed by their own terms and privacy policies, and we are not responsible for them.
10. Disclaimers
The Service is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that classifications will be complete or accurate in every case.
11. Limitation of liability
To the maximum extent permitted by law, Viz and its suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill. Our total liability for any claim arising out of or relating to the Service will not exceed the greater of the amounts you paid us for the Service in the twelve months before the claim, or one hundred US dollars.
12. Indemnification
You agree to defend, indemnify, and hold harmless Viz from any claims, damages, liabilities, and expenses arising out of your use of the Service, your data, or your violation of these Terms or applicable law.
13. Termination
You may stop using the Service and close your account at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or to protect the Service or other users. Provisions that by their nature should survive termination will survive, including ownership, disclaimers, limitations of liability, and indemnification.
14. Changes to the service or terms
We may modify the Service and these Terms from time to time. When changes are material, we will update the “Last updated” date and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
15. Governing law and disputes
These Terms are governed by the laws of India, without regard to its conflict-of-laws rules. The courts located in Rudrapur, Uttarakhand will have exclusive jurisdiction over any disputes, except where applicable law gives you the right to bring a claim in your local courts.
